Not all liquidated damages clauses are created equal. Will the LD provisions in your clients’ contracts withstand a motion for summary judgment if challenged? We will look at key provisions that every enforceable LD provision must include, best practices, and tricks for challenging and enforcing liquidated damages in construction contracts and contracts broadly.
