Understanding The Home Improvement Contractor Statute and
Its Impact on Claims Against Contractors
The Home Improvement Contractor Statute, Massachusetts G. L. c. 142A, applies to contracts for the performance of residential renovation services in excess of $1000.00. The failure to follow 142A’s strict statutory requirements can constitute a violation of the Consumer Protection Act. What trades are subject to 142A’s requirements? Are all 142A violations per se 93A violations? How do you defend against claims that your contractor client failed to comply with 142A?
We will review the basics of the HIC Statute, its interplay with c. 93A, and provide an overview of the law impacting contractors and homeowners.
